My Easy Party – Terms & Conditions

Welcome to My Easy Party (“Company”, “we”, “our”, “us”).
These Terms & Conditions (the “Terms”) govern your use of the My Easy Party website, mobile application, and all related services (collectively, the “Platform”).

By creating an account, booking a service, submitting a listing, or accessing the Platform in any way, you agree to these Terms. If you do not agree, you must stop using the Platform immediately.

These Terms apply to both:

  1. Users / Party Planners (“Users”)
  2. Suppliers / Vendors (“Suppliers”)

Additional policies may apply, including our Privacy Policy, Refund Policy, Supplier Guidelines, and Community Standards.

1. Definitions

  • User / Party Planner: Any individual or entity using the Platform to browse, inquire, or book services from Suppliers.
  • Supplier / Vendor: Any individual or entity offering products or services on the Platform (e.g., cakes, balloons, catering, rentals, décor, entertainment).
  • Booking / Order: A confirmed purchase or reservation between a User and a Supplier through the Platform.
  • Service Fee: The fee retained by My Easy Party for facilitating the booking.
  • Content: Any information, media, listing, photos, reviews, or materials posted on the Platform.

2. Nature Of The Platform

My Easy Party is a curated marketplace that connects Users with independent Suppliers.
We do not own, create, provide, control, manage, deliver, or operate any Supplier service.

All products or services are:

  • Owned by Suppliers
  • Fulfilled by Suppliers
  • The responsibility of Suppliers

My Easy Party provides:

  • A listing and discovery portal
  • Secure payment handling
  • Communication tools
  • Booking management tools

We are not a party to the contract between Users and Suppliers.

3. Account Requirements

3.1 Eligibility

  • You must be at least 18 years old.
  • You must provide truthful, accurate, and complete information.
  • You may not create an account for someone else without authorization.

3.2 Account Security

You are responsible for:

  • Maintaining confidentiality of your login credentials
  • Restricting access to your account
  • All activities occurring under your account

My Easy Party is not liable for unauthorized access caused by your actions.

3.3 Account Suspension or Termination

We may suspend or terminate accounts without notice if:

  • Fraud is suspected
  • Policies are violated
  • Harm is caused to Users, Suppliers, or the Platform
  • False information is provided
  • Abusive behavior occurs

We reserve the right to refuse service to anyone.

4. Bookings, Payments & Fees

4.1 Payments

Payments are processed securely through our payment partners.

Unless otherwise stated by the Supplier:

  • Full payment may be required at checkout to secure a booking
  • Some Suppliers may allow deposit-based bookings, but
  • The remaining balance must be paid in full before the event date

4.2 Supplier Payouts

Suppliers are paid only after successful delivery of the service or product, unless otherwise stated in a Supplier Agreement.

This ensures:

  • Accountability
  • Quality assurance
  • Fraud prevention

4.3 Service Fees

My Easy Party charges percentage-based service fees to Suppliers for facilitating bookings, maintaining the marketplace, and providing platform support.
These fees:

  • Are calculated as a percentage of the total booking amount
  • May varydepending on the service category, Supplier type, or operational requirements
  • May be updated or modified at any time, with or without prior notice

By placing or accepting a booking through the Platform, Users and Suppliers acknowledge and agree to the applicable service fees displayed at checkout or in the Supplier dashboard.

Unless required by law, service fees are non-refundable, including in cases of cancellation or disputes.

4.4 Price Changes

Suppliers may update their prices at any time before a booking is submitted. Once the booking is confirmed, the price is locked.

5. Cancellations & Refunds

5.1 Supplier Cancellation Policies

Each Supplier may set their own cancellation and refund policy.

Users must review these policies before booking.

5.2 Non-Delivery

If a Supplier fails to deliver:

  • My Easy Party may issue a refund at its discretion
  • My Easy Party may suspend the Supplier
  • A User may be required to provide proof of non-delivery

5.3 User Cancellations

Users may cancel a booking based on the Supplier’s policy.

Service fees retained by My Easy Party may be non-refundable.

5.4 Force Majeure

My Easy Party is not liable for cancellations or losses due to:

  • Natural disasters
  • Extreme weather
  • Accidents
  • Illness
  • Government restrictions
  • Unforeseen emergencies

Suppliers and Users must resolve these situations directly.

6. Supplier Obligations

Suppliers must:

6.1 Provide Accurate Listings

  • Use real photos
  • Describe products/services truthfully
  • Disclose limitations, restrictions, or requirements
  • Maintain updated availability and pricing

6.2 Deliver Services Professionally

Suppliers must:

  • Deliver products/services as described
  • Deliver on time
  • Maintain professionalism and proper communication
  • Comply with local laws, permits, and safety requirements

6.3 Ownership of Content

Suppliers confirm:

  • They own all photos, videos, and media they upload
  • They have permission to use any copyrighted materials

6.4 Fraud or Misrepresentation

Fraudulent or misleading activity may result in:

  • Account termination
  • Legal action
  • Loss of payout

7. User Responsibilities

Users must:

7.1 Provide Accurate Event Information

Including:

  • Date / time
  • Location
  • Delivery instructions
  • Venue restrictions
  • Contact information

7.2 Use the Platform Respectfully

Users must not:

  • Harass or abuse Suppliers
  • Attempt to negotiate off-platform to avoid fees
  • Post defamatory or fraudulent reviews
  • Damage Suppliers’ property

7.3 Payments

Users agree:

  • To pay all fees for confirmed bookings
  • That failing to pay remaining balances may result in cancellation

8. Delivery, Pickup & Setup Policy

This section outlines the rules and responsibilities for delivery, pickup, and setup services on the Platform.

8.1 Nature of Delivery Services

  • Delivery and pickup services are fulfilled directly by Suppliers, not My Easy Party.
  • My Easy Party does not manage delivery staff, transportation, timing, or quality.
  • My Easy Party is not liable for delivery-related issues unless required by law.

8.2 Delivery Availability

Suppliers may define:

  • Delivery zones and associated fees
  • Minimum order amounts for delivery
  • Special access instructions or setup requirements

Users are responsible for reviewing Supplier terms before booking.

8.3 Delivery Process

8.3.1 Delivery Window

Suppliers may offer:

  • Exact delivery times
  • Delivery time ranges
  • Pre-event arrival times for setup

External conditions (traffic, weather, events, etc.) may affect punctuality.

8.3.2 User Responsibilities at Delivery

Users must ensure:

  • Someone is available to receive the delivery
  • Access instructions (gates, buzzers, codes) are accurate
  • The delivery contact number is active

If delivery cannot be completed due to User unavailability or incorrect information:

  • The Supplier may mark the order as completed,
  • Additional delivery attempts may incur extra fees,
  • Refunds may not be issued.

8.4 Pickup Orders

8.4.1 User Responsibilities

If a Supplier offers pickup:

  • Users must pick up the order at the designated location
  • Late or missed pickups may result in no refund
  • Users may need ID or proof of purchase

8.4.2 Supplier Responsibilities

Suppliers must ensure:

  • The pickup item is ready at the agreed time
  • The pickup location details are accurate

 

8.5 Setup, Installation & Special Requirements

If a Supplier offers setup or installation (e.g., décor, rentals, balloon arches), Users must disclose:

  • Venue access restrictions
  • Setup time windows
  • Safety considerations
  • Outdoor conditions

Suppliers are not obligated to perform setup if conditions are unsafe or not as described.

 

8.6 Transfer of Responsibility

Once a delivery or pickup is completed:

  • Ownership transfers to the User
  • Responsibility for proper storage, handling, and use transfers to the User
  • My Easy Party is not liable for damage occurring after delivery

Users should inspect items immediately and report issues promptly.

 

8.7 Non-Delivery, Delays & Disputes

8.7.1 Supplier Delays

Suppliers will make reasonable efforts to deliver as scheduled.
My Easy Party is not responsible for delays caused by external conditions.

8.7.2 Non-delivery

If a Supplier fails to deliver:

  • Users must report the issue through the Platform
  • My Easy Party will investigate and may issue a refund at its discretion
  • Suppliers may face suspension or removal

8.7.3 Damaged or Incorrect Items

Users must provide evidence such as photos or video.
Failure to report promptly may affect dispute resolution.

 

8.8 Supplier Delivery Obligations

Suppliers agree to:

  • Deliver items as described in listings
  • Communicate delays promptly
  • Act professionally
  • Comply with local laws, including food safety, licensing, or transport regulations

Failure may result in withheld payouts, suspension, or account removal.

9. Reviews & Public Feedback

Users and Suppliers may leave reviews.
By posting a review, you agree:

  • Reviews must be truthful and fair
  • No abusive, defamatory, or misleading content
  • My Easy Party may remove reviews at its discretion

Reviews are public and may be used for promotional purposes.

10. Prohibited Activities

Users and Suppliers may NOT:

  • Circumvent the platform to avoid fees
  • Upload harmful or illegal content
  • Commit fraud or impersonation
  • Post misleading or inaccurate listings
  • Use the platform for non-event-related activities
  • Interfere with the Platform’s functionality
  • Collect information about other Users without consent

Violation may result in immediate account removal and legal action.

11. Limitation Of Liability

To the fullest extent permitted by law:

11.1 My Easy Party Is Not Responsible For:

  • Supplier performance or quality
  • Damages, injuries, or losses caused by a Supplier
  • Event issues (weather, venue restrictions, legal limits, etc.)
  • Incorrect information provided by Users or Suppliers
  • Payment disputes between Users and Suppliers
  • Technical interruptions or platform downtime

11.2 Maximum Liability

Our total liability, if any, is limited to the service fees paid to My Easy Party for the affected transaction.

We do not guarantee:

  • Availability of Suppliers
  • Accuracy of listings
  • Event success

12. Intellectual Property

All content created by My Easy Party—including branding, design, text, images, software, and features—is the exclusive property of My Easy Party.

Unauthorized use is strictly prohibited.

13. Privacy & Data Protection

We collect and process data following our Privacy Policy.
By using the Platform, you consent to our data practices.

Suppliers are prohibited from:

  • Misusing User data
  • Sharing User information outside the purpose of fulfilling an order

Violations may result in termination and legal consequences.

14. Dispute Resolution

Users and Suppliers must attempt to resolve disputes between themselves first.

If unresolved:

  • My Easy Party may, at its discretion, assist in investigating
  • My Easy Party’s decision on platform-related matters is final

Nothing in this section restricts legal rights under applicable law.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes must be handled exclusively in Ontario courts.

16. Changes To Terms

We may modify these Terms at any time. Continued use of the Platform means you accept the updated Terms.

We will update the “Last Updated” date accordingly.

17. Account Deletion

17.1 Requesting Account Deletion

If you no longer wish to use the Platform, you may request to delete your account at any time.

To proceed with deletion, you must:

  • Navigate to Account Settings in your dashboard
  • Select “Delete My Account”
  • Follow the required confirmation steps
  • Verify your password for security purposes

17.2 Effects of Account Deletion

By choosing to delete your account, you acknowledge and agree to the following:

  • Permanent Removal: Your account, profile details, listings (if applicable), and personal information associated with your account will be permanently removed from active access on the Platform.
  • Access Termination: You will no longer be able to sign in using your email or access any features of the Platform.
  • Loss of Data: You may permanently lose access to your past order history, messages, and communications conducted through the Platform.
  • Cancellation of Upcoming Bookings:
  • For Users: All upcoming bookings will be automatically cancelled, and refunds (if any) will follow the Supplier’s cancellation policy and our platform policies.
  • For Suppliers: All upcoming orders will be cancelled, and pending payouts may be withheld if a dispute or quality concern exists.
    • Irreversibility: Once confirmed, account deletion cannot be undone.

17.3 Exceptions & Platform Retention Rights

Although your account will be deleted, My Easy Party may retain certain information as required for:

  • Compliance with legal, financial, or regulatory obligations
  • Fraud prevention
  • Security and system integrity
  • Resolving disputes or chargebacks related to past bookings

This retained information is not used for marketing and is handled in accordance with our Privacy Policy.
